This call was raised with one of our larger software suppliers.
‘From 10 April 2006 the law allows us to recover overpayments from anyone who contributed to the overpayment. This can include a partner, a non dep or any other such person. How could recovery from a third party be enabled in through your benefits or debtors system?
If this requires a further system change, the system would have to allow a choice for recovery to continue from the claimant or from the third party should the claimant come back on to benefit’
We got this back
[quote:0c39843d77]we are not currently looking to enhance the product to be able to recover from anyone other than a CL or LL payee. The only way you could attempt recovery from a Partner using the system would be to make them the claimant and if the claim is still active with the existing claimant this would not be possible. There are no plans for recovery from non deps either using the current functionality. Any overpayments you want to recover this way will have to be done manually
If you would like this change to be considered you can raise an enhancement request[/quote:0c39843d77]
Good to see that they are keen on complying with legal requirements. I would love to name them but Admin would tell me off!
