Bit of a mess!!

    We have a claim that was referred to the rent officer in October 2003. It was not received by the rent officer and was re-reffered again in Feb 2004.

    This was also not received by the rent officer!! New claim came in May 2005 for rent and ctax.

    This error was picked up at this point. It was referred to fraud as neither the landlord or the tenant had queried why no rent was paid.

    Landlord states that he thought it was paid to his wife and she states she thought it was paid to him. They both live in the same house. Claimant states thought it was paid to the landlord.

    Fraud then requested that the landlords come in for further questioning and they have refused.

    Any thoughts on what to do next?

    What prompted the new claim in May 05 and what has been happening between then and now?

    Stainsby does make an interesting point. Have any LA’s come unstuck recently in arguing that couples ought reasonably to know about each others financial dealings!?

    Between May 05 and now the fraud dept have been working on this case and the landlords as well.

    Final letter only sent 14 February 2006 to the landlords for further info which they did not answer.

    Sounds like all you can do now is make a decision and then see what happens appeal-wise.

    As to what decision – no liability to pay rent, or liability not commercial, or both. Or just refuse for lack of response to request for info.

    I would go for no proven liability based on the details here. Has there been any evidence of payment of rent provided as I don’t see that there has. If that is provided you could then revise to a non commercial tenancy.

    (And then take it from there!!)

    Do I know what I'm doing? The jury's out on that........................

    Just been given a statement from the claimants landlord now stating that him and his wife both thought the other one was receiving the rent but hiding it from each other!!!
