Bulgarian and Romanian Nationals

    Has anybody looked the SI’s yet to do with Bulgarian and Romanian Nationals? I’ve read and re-read them and they go into chapter and verse about their rights to work in the UK and that seems fairly straight forward BUT it says very little to nothing about benefit entitlement 🙄

    Am I right in thinking that nationals of these two countries only have a right to reside if they have worker authorisation? no ifs buts and maybes and no self sufficiency test/unreasonable burden like for A8 nationals?

    Also noticed that these two countries are now called the A2 accession countries, so where have Cyprus and Turkey gone cos that’s what they were wasn’t it, are they now in the EEA proper? 😕

    My understanding is that Bulgarian and Romanian nationals will in effect be treated in exactly the same way as the original “A8” nationals. The only difference is the legal process they go through to work legally is “worker authorisation” rather than “worker registration”. If they are authorised they derive their right to reside from that and will be exempt from HRT. If they are not working the same provisions (HRT, self sufficiency, unreasonable burden) will apply. I assume that a circular is on its way…?

    Now tell me I’ve got all this wrong!

    PS – the A2 countries were Cyprus and Malta (not Turkey)….about the only thing I am sure of.

    Oh yes, so it was – was thinking about Turkish Cypriots and they are another thing altogether 😳

    Thanks for that. Just want to try and get my head around it cos we’re bound to get a claim.
