    Trying to find a commisioners decision regarding a claimant spending all their capital and then claiming benefit. Was along the lines of “you can’t spend all your money and then expect to claim benefit. Am I imagining this or is it wishful thinking ❓

    It’s probably the same one that says “you cannot rent a house from a relative and expect to claim benefit”.

    OK, serious answer, CH/1873/2005 was a case where the claimant gave away most of his money to his grown up children, safe in the assumption that the social security scheme would not let him go hungry and homeless. He wasn’t getting rid of capital with the specific aim of receiving benefit, but he was disposing of money in a way he probably wouldn’t have done if there were no social security scheme.
