CAPITAL OR NOT?

    We have a customer who has power of attorney for his son as he has learning difficulties. His son has recently had a backdate of DLA which has been paid into the customers account (the son’s name is not on it). If this was the customers we would disregard this but 1) should we disregard if it is for a non dep and 2) If the capital is his son’s can we ignore it

    The money is not your claimants so you can ignore it. It should be ringfenced of course; it is not paid to your claimant. However, unless you have compelling reasons to believe your claimant is misuing their POA powrs (which would be a criminal offence) then no worries.
