A couple are renting a caravan on a site which is open 11 months of the year. They are charged £400pcm. They have been advised by council staff that they might not be entitled to HB. They are only in the caravan on a temporary basis, as they are waiting an allocation from their local Authority (the couple made a homeless app but were unhappy with the temp acc offered by the L.A, hence they found their own!)

Any help would be appreciated so I can advise correctly.

    Many Thanks

On what grounds have they been told they may not be entitled?

They have been told that as the caravan is in effect a holiday let; the site is not a residential site and is only open 11 months of the year.

Try going to the caselaw part of this site, click search and then enter 0318. It should come up.
