I have a new claim for a young girl who was formally living with her partner and their baby daughter. This relationship has now broken down and she has moved into her own flat. The baby is being cared for by the father.
She is 20 years old and a former care leaver, however she continues to be supported by the Leaving Care Team and they have a duty to support her until she reaches 21.
My question is: Should she be entitled to the LHA one bedroom rate as a leaving care claimant under 22 or should we apply the shared bedroom rate?
