Am after a case that has been quoted at me, regarding an appeal am dealing with. Can anyone help! Have looked just about everywhere I can think of and cannot find it. 🙁

It is R v Sheffield CC HBRB ex parte Smith & Others [1994]. It is quoted in Zebedee/Ward/Lister 2006-07 edition, 2.44, page 39. Is regarding non-commercial agreements.

Caution – often quoted by reps for clmts; usually along the lines that it is wholly definitive. A careful read will soon establish it is not as clmt-friendly as it first appears.
