    Does anyone recall a case that had been looked at by a Commisioners only to find that when the Commisioner came to rule on the appeal, the Local Authority had already changed the decision. The commissioner made comments regarding this implying that to have amended a decision before it had been dealt with by the commisioners was inappropriate.

    It would be much appreciated if someone could point me in the right direction.

    The Council may “supersede” a Tribunal’s decision if new evidence comes to light, but if it does that while the matter is already in the hands of the Commissioner a horrible mess results – is that what you were thinking of?
