Cases which are never referred to the Rent Service

    I have a claim from an elderly lady who has lived at her current address for the last 50 years, she applied for HB in Oct 2003. Should this case have been referred to the Rent Officer?

    No don’t think you need to. It looks like the tenancy pre dates 15/1/89 which means its regulated and is not referrable to the rent officer.

    No, but you might want to check with the Rent Service to see if it has ever been registered. If it has been then the L/L can only increase rent after applying to the Rent service every two years. Of course you might be able to restrict under the old reg 11 if it is not registered, but I suspect it’s probably a reasonable rent anyway.
