    Am I being slow off the mark here?
    Following this Comms decision, all I have done is to run a report to identify “exempt accommodation” with high rents in my area. I am now waiting a bit to see if the decision will be appealed further, or if we receive further guidance from the DWP.

    However, reading the posts on boards such as rightsnet it would appear that all LAs have been told to review these cases and that large numbers of claims have already been reviewed and HB payments slashed.

    Have I missed something or is this just hype by some providers trying to cause a panic in Government?

    No you are not being slow. Trouble is, the potential impact is dire and I suspect most are waiting for DWP to advise. So far they have not done so. Closing down schemes for the vulnerable and forcing them to evict is the claim being made and I would hope some compromise could be reached.

    The sheer fact that no on has jumped on to this thread to confirm that they are indeed cancelling cases does suggest that there may well be an element of hype, as you suggest Jeff.

    We for one (or three if you incldue the two previous posters) are not intending to spring in to action without clear guideance from DWP.

    I am currently looking at an appeal where we have actually reduced the eligible rent to the rent officers figure and HB has indeed been slashed. Are we alone? The basis of the appeal is that they monitor that the care given is regular.

    Carol, my first thought was I am not sure you can just reduce to RO figure. I had presumed old reg 11 would still apply – so is it a private provider that is not exempt?

    I assume that the case in Carol’s post is one found not to be exempt following the Comms decision and therefore old Reg 11 would not be a factor.

    Yes Jmembery you are right in your assumption. The care is not provided by the landlord so Reg 11 does not apply.
