Change in Pension Credit

    I know I should know this but I am being particularly dopey this morning.

    Customer is receiving PC(SC) and HB/CTB, customer has a change in their PC(SC) award in July 06. Pension Service do not tell us of the change but the customer sends in her revised PC(SC) award leter dated July and we receive it in August.

    PC(SC) has increased so HB/CTB decreases.

    If the Pension Service had advised us of the change we would do it from the Monday following receipt of the ETD but as they haven’t notified us and the claimant has when do we amend it from?

    It is still the Monday following the ETD – there just isn’t any provision to do it from an earlier date. Extract from Reg 60:

    (2) Where the change of circumstance is that an increase in the amount of state pension credit payable to the claimant results in—

    (a) an increase in the rate at which housing benefit is payable to him, the change shall take effect from the first day of the benefit week in which state pension credit becomes payable at the increased rate; or
    (b) a decrease in the rate at which housing benefit is payable to him, the change shall take effect from the first day of the benefit week next following the date on which—
    (i) the local authority receives notification from the Secretary of State of the increase in the amount of state pension credit; or
    (ii) state pension credit is increased,

    Thanks Peter, the problem is we have not received an ETD from the Pension Service, the change has come about because the claimant has sent ion their revised PC(SC) award letter.

    I assume based on the extract that because we haven’t received notification from the SOS we should go back to the date the PC(SC) increased.

    I don’t think so James – you will have to get onto TPS and ask them to send you and ETD. The ‘either/or’ in the legislation is dependent upon which event happens the latest, and doesn’t allow any leeway for when an ETD is not received.
