Change of circs and rent increase – when rent inc effective

    We have a claim where we are currently paying the rent plus £15 cap and the 3 bedroom requirement was such that the LHA rate is still in excess of the actual rent charged + £15. This claim was originally assessed in April 2009 so had an LHA anniversay of April 2010. A change of circumstances which increased the bedroom requirement to 4 took place in March 2010 so this then moved the anniversary date to March 2011. The claimant has now notified us that the rent has been increased in May 2010 which would mean we could pay a little more if we could process the claim using May 2010 LHA rates. However, I believe that I am unable to adjust the rent and LHA rate until March 2011 as the anniversary date has already been moved forward to that date. Am I correct and does this means that if the claim has another relevant change after May 2010 I can then incorporate the rent increase or does it mean that I have to wait for the anniversary date of March 2011 to apply the change.

    The first applies; if a relevant change (a non-dep moves in or out for a week might be enough) occurs, you would revise based on the circumstances in place on that date.

    Thanks for that…logical really…otherwise we may have waited a long time for any rent increase to take effect had other changes of circumstances (which changed LHA anniversary date) kept occuring!
