Change of Circumstance BVPI’s

    Can you give me the benefit of your opinions: –

    A claimant provides his payslips each week, however the LA does not look at them until three have been received. How would you assess them in relation to the BVPI’s?

    a) Assess them individually because each payslip is an separate c/cirs and requires its own ‘FI & IR’ date.

    or

    b) Calculate the average of the payslips (more beneficial to the clmt) and use the date of the first payslip as the ‘FI’ date and the date of the last payslip as the ‘IR’ date.

    Or can we do it either way and still be calculating our BVPI’s correctly?

    In my opinion you need to decide whether it is one coc or 3. If he has for example changed jobs but you want at least 3 wage slips before you supersede then it’s 1 change with the date of first wage as FI date and the last one the IR date.

    If however his wages fluctuate greatly then ,to me, each wage is notifying a coc and accordingly each should be done individually.

    The fact you waited for three though pushes me towards the first.

    I’d go with b) although, personally, I would assess on the first payslip, wait for the second, work out the average of the two, wait for the third etc etc etc.

    Its not that they waited for the three payslips, its a case of the first payslip wasn’t looked at untill all three had been received.

    Work load problems (don’t want to use the dreaded ‘b’ word)

    It is but I got stung once at a tribunal. O/P was caused by waiting for 3 payslips, the chair said a reassessment could have taken place 2 months earlier when the 1st payslip arrived. 😥

    Couldn’t you action from the first wage slip upon reciept and treat the 3rd wage slip as a request for a revision of your original decision, therby not counting for PI’s???
