    We are having a debate on our team at the moment and would appreciate some advice on what others do:

    We have a full time foreign student who’s partner is here on a visa as a spouse of a student and has no recourse to public funds, but is allowed to work.

    In order to be exempt does she need to have:

    A:
    – A visa as a spouse of a student
    – no recourse to public funds
    – be prevented from taking employment

    So all 3 conditions, or

    B:

    – A visa as a spouse of a student
    – And one of: having no recourse or not being able to work

    Hi

    Did you resolve this question. i have a similar case where i would like to check if full exemption form council tax should be granted .

    The main lead liable person is a full time student.

    His wife is a non student who has joined him under a spouse visa, she is allowed to work but has no recourse to public funds.Is she also disregarded, if so could you confirm where i can find the guidance/legislation for this. (my background is benefits related )
