Child care and working for self employed husband

    Hi

    We have a case where our claimant and partner wish to claim the Child care disregard.
    HMRC pay in their tax credits.

    problem is husband is a self enmployed painter and decorater and ’employs’ his wife for 16 hours per week paying her £10.00 per week to do his admin work.
    Wife works from home!
    children go to a childminder ( why i do not know!)

    is there anything we can do not to include the child care??

    You could make a decision that the wife is not in ‘remunerative work’. Maybe you could ask exactly what she does during those 16 hours, and how a painter has so much paperwork to deal with!

    If we allow CCC on basis of ‘remunerative work’ does anyone think it would be reasonable to use 16hrs at minimum wage as an income for the partner?

    Notional income depends on the employer being able to pay the going rate, and also some analysis as to what the partner actually does. I think you need to establish the facts first – does she really work 16 hours per week?

    If you do apply notional income will you notionally reduce the claimant’s self-employed earnings to take account of the amount he should notionally be paying his partner? :glasses:

    Are you 100% happy they are going to a child minder? Have actual receipts been provided? Could it be that the “child care” is being fabricated for tax credit and HB purposes?

    Yes completely happy with the childminder side of things – we have a form that childminders hae to complete given detials of costs and their registration number – and that’s all ok.
