If a child is a weekly boarder at a fee paying school, but a small allowance has been made within a tax credit award for child care costs (not sure at this stage exactly what this relates to) are we bound under Reg 28 (8)(b) of the HB 2006 Regs to accept this as allowable for a child care disregard for HB purposes?

My initial answer would be no. Since the fees are paid for schooling and not child care. Reg 28 (7) (a) says that charges for a child’s compuslsory education are excluded.

However you may have to look at if the charge relates to care for after school hours as mentioned in regulation 28 ( 8 ) (a) (i).
