claimant on Pension Credit wanting to withdraw claim

    We have had a letter from the daughter acting for her mother ( Power of Attorney).Mum is in receipt of PCGC, daughter has found out that her mother has capital she never declared ( £42,000!).The daughter found this out when she was clearing the house after Mum went into residential care.
    Now the daughter has written to us to say she wishes to withdraw her mother’s claim completely and repay any overpaid benefit.
    However, at the moment she remains entitled to Pension credit.The claim has ended now anyway as she has gone into residential care.
    My dilemma is, do we do as the daughter has asked and cancel the claim from the start, or as the claimant is receiving Pension Credit, leave things alone and only cancel if the Pension Service confirm that entitlement to pension credit has ended? ( even then, they may not cancel the pension credit all the way back if she has an AIF and they consider it wasn’t claimant error) .
    Anyone got any suggestions?

    I would wait and see.

    That’s £72 a week of tariff income (£64 while in residential care), so it’s not absolutely impossible that she was properly entitled to Guarantee Credit while on HB/CTB. I know it’s unlikely that she didn’t have at least a Cat B Pension that would take her over the GC limit, but I would let DWP deal with it before leaping to any conclusions.

    There is always a possibility that DWP won’t care, in which case you are pretty much stuck with it.
