Claimant is SMI and has made a claim for CTB

    The claimant is SMI due to a severe personal injury.  He lives in a property of which he owns 96.8%  and his parents own 3.2%.  This arrangement exists because the property is held in trust for the son by the parents.  At the moment council tax have him as solely liable with a disabled reduction. 

    Am I correct in assuming that if he is the only liable person then he can claim CTB on 100% with the parents as the non dependents?  A solicitor is stating that he can claim 50% in his own right.   Or are we both incorrect and is there another option?

    Opinions please.

    Your question is a bit confusing, are the parents resident? Why would they be non-deps?
