I remember recently reading a CD (of sorts) in regards to the Postal system.

Any ideas as to the reference number and where I can get it from?

Do you mean Consignia v Sealy? If so I have a paper copy (might even have an electronic one somewhere)

Do I know what I'm doing? The jury's out on that........................

Amongst other matters, it is reasonable to expect that normal postal delivery has occurred unless there is evidence to the contrary.

I used to regularly cite CSIS/48/1992, but it was overturned on 6 May this year by the Court of Appeal in Levy v Secretary of State

Although the Consignia one was the one I was thinking about, it wasn’t the one I wanted.

I am certain that I have seen a CD that basically states that if something has not been recieved although stated as sent, it cannot be considered.

Or have I been asleep for a while and dreamt this?

The Levy case considered the issue (although not quite in such stark terms)

I don’t think you’re dreaming. Wasn’t there a recent(ish) CD about an LA sending a renewal form and it not being received? For the life of me I can’t trace it though.

    Has anyone else any ideas?

I have just used CG/2973/2004 in an appeal submission. Any use?

CH/4217/2003 may be of interest too.
