    Can someone help me out here please?

    I’m looking for a Commissioner’s Decision that states a claimant can “withdraw his claim” at any time when the claim is in payment. I seem to remember the Commissioner stating that to refuse to allow the claimant to “withdraw his claim” was in breach of the claimant’s Human Rights.

    (before anyone points out that a claim ceases to exist once a decision is made etc…I know 🙂 – just being lazy with terminology)

    Try CH/1815/2005, which will be reported as R(H) 2/06.
