Could this be a 1 bed rate?

    We have a claimant who lives in a shared house and has sole occupancy of one room only, but she has sole use of a bathroom. This bathroom is a makeshift cubicle in this room, in which there is a toilet/shower and basin. She shares the kitchen.

    Am I right in thinking even this makeshift cubicle in her room can be counted as sole use of a bathroom?

    Even if she had sole use of a bathroom this is not a room for living so its still a shared room rate rate.

    Hi Steve, thanks for your reply but I thought that she could have exclusive use of one room for living, (which she has) and exclusive use of a bathroom and toilet (which is the point I’m querying) and a kitchen or facilities for cooking either shared or non shared, which she has. The point I’m querying is whether the “cubicle” could be classed as a bathroom.

    If the Kitchen is shared it is not self-contained and will not get a 1 bed rate. The Kitchen or facilities for cooking must not be shared:

    13D(b) (ii) the claimant (together with his partner where he has one) has the exclusive use of one room, a bathroom and toilet and a kitchen or facilities for cooking,
