Council Tax Benefit Disregarded person and Non Dep

    Hi,

    I have a claim where the liable person (resident owner) for Council Tax is disregarded as a carer.

    They have had a non dep (on Pension Credit) move in with them.

    Obvioulsy this means they now have a 75% Council Tax charge (50% property plus 25% single person)

    The non dep cannot claim full CTB can they as they are not the liable person

    Is there a regulation that allows us to award Council Tax Benefit to the resident owner (despite them being disregarded) on the property for the full 75% charge.

    I have something at the back of my mind which says we can get round this problem with students, i was wondering if there was the same provision for carers.

    I didn’t get a response in the end.

    I took the decision to pay them the full 75% CTB as the disregarded person is still liable to make any payments regarding Council Tax on the property.
