Council Tax liaibility for members of the Armed Forces.

    Sorry to bring this up here again. Can anyone point me in the direction of judicial decision form memberds of the armed forces who own other properties. They live in barracks where their mess fees include a council tax element but they also have anotherr home.
    The soldier is renting their property to her father, but is keeping a bedroom in the property.
    Our CT dept has made the L/L liable for CT even though she stays on a military base.
    The CAB have challenged this on the grounds that she pays CT to the LA where she is based.
    I have seen reference to Anderton/Stark/ Codner on the message boards where can I find those cases please?


    Your Council Tax office should be able to obtain these for you. If not I have paper copies of Anderton and Stark which I could send you. I have used these on an HB/CTB appeal where the claimant was found to be living with her husband even though she maintained he was working away. Cue Anderton (the merchant seaman case)…………

    NB decision has just been confirmed by TTS as correct!

    Do I know what I'm doing? The jury's out on that........................
