CTB Extended Payment Query

    Hi all, I would be grateful for some advice/opinions on the following.

    Claimant begins work, JSA ends 4 July usual conditions satisified so claimant is entitled to EP from 11 July.

    However, on 9 July there is a change in Council Tax liability effective from 10 July (single person’s discount removed). Due to the 2 changes rule, the end of JSA is taking effect from 10 July and entitlement is reduced to nil for that day.

    Am I right in thinking that the reference to ‘last benefit week’ in reg 60B means that the claimant is still entitled to an EP even though the last day was nil entitled?

    Or does one day of nil entitlement in the ‘last benefit week’ mean the claimant is not entitled to an EP at all?

    I think the intention is that the claimant should be awarded the EP because of the reference to ‘week’ rather than ‘day’ but would like to be sure…

    Hi Kay, I did see that forum before making my post… it’s clear on how much to pay but my query is really about whether or not an EP should be paid.

    I’m leaning towards paying because of the reference to week rather than day (i.e. 6 days of entitlement vs 1 day of non-entitlement) – and also because the whole point of the EP is to ignore the claimant’s income so they don’t lose out when they start work.

    However, because the two changes rule has taken effect I just want to make sure that there isn’t an issue with nil entitlement (albeit for only 1 day).

    I would definitely award the EP. Reg 60B determines the amount of the payment – it is not a threshold eligibility condition. You would not even get as far as Reg 60B if the claimant were not otherwise generally entitled to an EP under Reg 60. Also, as entitlement to the QIRB has ended in the week beginning 4 July, the CTB week that determines the rate of the EP is the w/b 27 June in accordance with Reg 60B(1)(a), and that was a full week of CTB.

    We keep going round in cirles with EP and I can’t get it round my head some times, Like PeterB said it’s an award…………..may change my mind again……………… 🙂 just joking………
