Debt Relief Order & Recovery of Overpayment

    Where do we stand if someone has been granted a debt relief order & we have been recovering a housing benefit overpayment from ongoing benefit since 2009?

    Well, as far as I know, you stand ok. As long as the relevant amount of deductions, by law, is all you are taking.

    Bulletin G12/2010 contains instructions from the DWP on how to treat overpayments where there has been a DRO.

    The advice was that Local Authorities must stop recovery of these overpayments but keep a note of the cases for future reference as they have appealed and are awaiting a decision.

    The DWP were advised to refund any monies collected from the date that the DRO was effective from, however the advice to Local Authorities was to not refund any monies for the time being but stop recovery.
    In your case as the bulletin came out in August 2010 I think you would need to consider refunding any monies that you have recovered from them since that date and then pend recovery until we are advised on the next course of action
