defective claim

    bon martin,

    if a claim is made defective, as info has not been supplied within a calendar month and then we subsequently receive info within a calendar month after that and we pay the claim in accordance with the regs.

    do we regard this as a revision? as making a claim defective is not a decision, as no money was paid, so therefore it cannot be a revision as actually no decision was made

    is that correct? and if so what do we regard this senario – a change of circs?

    Yes, it is a revision.

    The decision that someone is not entitled to benefit because their claim is defective is a decision and carries a right of appeal.

    A nil decision cannot be superceeded but it can be revised.
