Defective claim based on Est earnings becomes eligible

    A claimant has only been in employment for 2 weeks and can only provide 2 payslips. Based on this we process their claim and issue an estimated earnings letter saying that when the rest of their paylsips become available we will recalulate their earnings. Based on the 2 payslips they are not entitled to benefit.

    When they provide the rest of their payslips should we be asking them to complete a new form as there has been a period of nil entitlement and we think they will now qualify or can we just revise our decision?

    Just revise. I’d treat it like a payment on account.

    Sometimes the clt doesn’t qualify for HB when using the indicative rent but does when the final RO decision comes back.

    I don’t see why this is very different.

    Are you an SX3 user? If so, how would you deal with that – would you re-open the same claim period or set up another one as a CONTINUE rather than a NEW?

    Yes, SX3 here.

    If the claim had been cancelled by the time you get the info then set up the new period as continue.

    If the period hadn’t yet been cancelled then I’d just reassess the income.
