Dep turns to Non-Dep in 65+ Household

    Re the delayed non-dep deductions: does this apply where a dep is already living in the property of a 65+ clt, and then has their birthday which makes them a non-dep? The regs seem to suggest that it’s a no, but this seems a bit unfair! Thanks.

    Originally the regs stated that a non deps change in INCOME was the thing that lead to a non dep delay – but since then its been clarified that any change to a non deps circumstances which is detrimental to clmts benefit can be delayed IF THE NON DEP IS ALREADY CLASSED AS A NON DEP.
    If Gladys has 2 grandkids – both aged 18 – 1x full time education and she gets C/ben (dependant) 1 x working 20 hrs (non dep)
    If the one in f/time ed leaves it becomes a non dep – the charge is taken straight away – as this person hasnt joined the household but has become a non dep –
    if the one working gets a pay rise then this is delayed 26 weeks. as was already a non dep , then had a change.
