Dependant child in long term Youth Custody

    We have a claim from a person who’s teenage son is detained in Youth Custody on a long term basis (well over 52 weeks)  He does not get child benefit for him.

    The Youth Offending Team have advised us that our claimant is his son’s ‘responsible adult’ but I’m not sure what that means exactly.

    Should we be including the child in Youth Custody as being part of the household as it is still his main home, although he is not there. Should we allow a premium for him in the applicable amount, and a room under LHA/new Social tenancy guidelines. He had already been in custody for 2 or 3 years.
