Deported from country where has another property

    Hi

    Does anyone think I can stretch Schedule 6 para 27 to allow me to disregard my appellants property abroad.

    Appellant has a property in Turkey.
    She was recently deported from Turkey due to working illegally, she is chellenging this and in the meantime her Turkish property is unoccupied. Her intentions is to return to live there.

    Does anyone think para 27 can apply as she is seeking legal advice to be able to return to the country to occupy the property??

    I think it depends what you mean by “stretch”! Para 27 seems to be about taking legal steps to take possession of the dwelling, whereas it seems that title to the dwelling is not in question – her problem is getting into the country. I always thought this para was meant to cover the situation of getting a property back from squatters/illegal occupiers. On the other hand I suppose it could be argued that she cannot exercise her rights over the property if she cannot regain entry to the country, so is there really a distinction? I think it’s arguable either way.

    Hi, that is what I was thinking, indirectly her deporation has stopped her being able to take occupancy of the property, she is taking legal steps to allow her to move back, thus taking legal action to regain occupancy of the property???
