DHP and Non Dep

    Hi, I have a DHP request, meets our criteria to pay but there is non dep deduction, I don’t think I need to cover this part of the rent, but guidance only refers to service charges etc which can not be paid via DHP.

    Any thoughts?

    You can pay a DHP up to the value of the non-dep deduction if you want to, plus any other shortfall between the eligible rent and the benefit entitlement. Only ineligible service charges cannot be met by a DHP.

    You can pay to the full value of the rent liability and/or the full council tax liability, even if it is all covered by Benefit’s (see the commentary at the bottom of p1090 of the main CPAG book for 2005/6). This would be unusual, but is technically possible 😈

    The amount of benefit being paid does not have to be taken into account.

    we have paid dhps in order to cover nondep deductions for several cases now where we are satisfied the non dependant won’t pay the nondependant charge for housing/council tax benefit.
