We have just had a request from a Landlord for payment direct as tenant more than 8 weeks in arrears. On checking further the Landlord states that no rent has been paid since the date that the tenancy commenced, DHP has however been in payment at £50+ per week, could we cancel the award back and attempt to recover from the tenant if it is confirmed that no rent has ever been paid?

On what grounds can you cancel it just because clt hasn’t been paying rent (unless you think it is a sham)?

The application was fraudulant, the grounds for the request was that homelessness would be iminant if the full rent requested could not be met, however as they have never paid any rent it could be deemed that the intent of their request was to obtain money for other purposes other than that stated which is deception, intent+deception = fraud, obtaining money under false pretences, theft act

So what HB Regulation is that under then? They may have misappropriated their benefit but it doesn’t mean they weren’t entitled to it
