Dispute against o/p decision following IS end

    I have a customer asking for reconsideration of a decision that created an overpayment as a result of their Income Support being cancelled from May to August 2006.
    The reason for the IS stop was excess capital above £8,000. The IS went back on from 8-8-06. The customer has appealed to DWP against the decision and is awaiting their reconsideration.
    Am I right to think that I can’t reconsider HB & CTB for the period (by way of UNENT) at this time because of the outstanding Appeal with DWP?
    The customer has supplied details for two accounts for the period held but they show IS credits, do not have total balance exceeding £8,000 and they have said they do not hold any other accounts.

    Capital limit for IS, from April 2006, is £16,000.

    The issue I am trying to get around is the fact that there is an Appeal in against the IS decision – can I change the HB/CTB decision that occurred as a result of this whilst it is under Appeal, or do I have to wait?
