i know its disregarded but Im having trouble finding the disregard of DLA in pensioner Regs (non pension credit claim) anyone ?

Also, can anyone offer any logic/reason why DLA is disregarded and SDA is not ?

    Many Thanks

It’s Regulation 29(1)(j)(i) of the Housing Benefit (persons who have attained the qualifying age for state pension credit) Regulations 2006.

SDA is an earnings-replacement benefit, and there is therefore no logical reason why it shouldn’t be treated as any other earnings-replacement benefit (such as Incapacity Benefit, Retirement Pensions etc). DLA serves a wholly different purpose, recognising that severe disabilities lead to additional costs that able-bodied people don’t incur.
