does sole use no longer apply?

    Hi

    this is neither a blond moment, a friday pm or monday morning query. i am just not confident on my reasoning.
    i have read my books looked at regs and still in a quandry.

    we have a claimant and under all normal rules is LHA. his claim was running smoothly , he had room, shared facilities and paid on shared room rate. THEN

    another perosn moved into his room and that person is neither a friend, partner, non dep, dep just a seperate person (once a stranger now a close room mate). the landlord put two beds in large room, charged each person for the ‘room’ and now we have bother persons making seperate HB claims.
    Both persons being charged £100.00 each

    am i going daft – can i pay both ?
    they don’t have to have sole use do they?

    That’s just taking the p***. I can’t see anything for it but to pay 2 lots of shared room rates unless you reach the conclusion that the “tenancies” (for want of a better term) are contrived – doesn’t help the clt though. Poor man, having a complete stranger imposed on him.

    Well, at least for once the popular term “shared room rate” is accurate

    I would want to ask what happened to the original tenancy – was it properly brought to an end by the landlord and tenant, ie was notice given? If not, what right did the landlord have to relet the same premises?

    thanks for all advice.

    the tenants appear to have some mental health issues and we have forwarded this info to other services and our environmental health team have gone to property and are advising l/l on issues with regards to living standards etc.

    thanks again for assistance and confirming that sometimes first instincts are right.

    some l/l’s have a blinking cheek. only thing wrong is the moral issue.
