EEA family members right to reside or not

    We have a person who works 16 hours a week and earns £100.00 weekly. She does have a partner who does not work and 6 children. Tax credit entitlement is high.

    Her two parents have come to this country from Belgium and she is supporting them as acending dependants. They do not live in her house with her family but have rented accommodation elsewhere. The DWP state that they are not entitled to pension credits. They have no income or savings and are aged about 65.

    Given that the actual amount of her earned income is so low and it would not be possible to support such a large number of people if tax credits were not in payment, are the parents entitled to housing and council tax benefits?
