Enquiry from 1999

    Just received an enquiry from care worker.

    Tenant/Client of theirs has received demand from rsl for rent arrears which they *think* originate from 1999.

    Oddly enough, these old paper files have just left for the big filing cabinet in the sky (shredded)

    It is over 6 years – can I say that we are no longer obliged to keep & provide records for that period ?


    The simple answer is “Yes you can”.

    The LA is not required to keep files for ever on the off chance that someone might have an enquiry going back eight years.

    There “could” be issues if a claimant were to request a fuller statement of a decision that was made some years ago, but even here Commissioners appear to be taking a reasonable view of circumstances where papers have been destroyed as part of run of the mill file maintenance.
