We have a claiamnt who failed to sign on as he started work, he did not tell JSA about the new job. JCP then end the JSA award but are not going back to when he started work 2 weeks earlier. Therefore, JSA ends 2 weeks after his employment started. My questions are is the CL still entitled to the EPP and if so, when does the 4 weeks EPP start, the date he started work or the date JSA ended (albeit wrong? Thanks.

Just wondering have you been given a reason as to why JSA are paying an extra two weeks? Surley they need look again at the decision? Are you sure they have not raised an overpayment?

We have contacted JSA and they have said there is an OP but they are not going to recover it?

Well an EPP is awarded from the monday after the date the change occurred(starting work) so i would say 4 weeks from the monday after he started the job.

Does it matter that JSA ended as he failed to attend rather than him telling them he started work? Thanks for your help.

Well this would complicate matters but the fact that JSA are not recovering seems to suggest that they have made a mistake and that maybe the claimant did tell them he/she started to work and they delayed in actioning this. It is up to us to determine weather the cl is entitled to an EPP. I would go back to JSA and ask why there are not recovering.

I think the ‘qualifying benefit’ should have stopped for ‘work-related reasons’ (i.e. started work or increased hours/earnings) for the claimant to be entitled to the EP… based on your post this doesn’t seem to be the case.

Can’t you check CIS for notes to see why JSA has ended from the date it has?

We have phoned JSA and they are not beign very helpful, only saying it’s ended and they are not recovering the OP. Stopping the QB for “wrok related reasons is open to interpretation – he stopped attending and signing on because of “work related reasons”, i.e. he started work. Therefore does this not apply?
