ESA and Earnings Disregard

    Claimant makes a claim for ESA as has not been with her employer for long enough to get SSP.

    The claim has been left running with Working Tax Credit which she continued to receive for some time and we have also left in a number of hours worked each week and therefore the claim has attracted just the £17.10 disregard.

    Somewhere I think this is not correct however if she still remains employed by her employer could she attract this disregard?

    As she has been off sick she can’t get the ADED but the WTC in payment would still award it anyway. Opinions differ on whether a claimant on SSP should be awarded the ADED but, IMHO, if HMRC are not aware she is off sick then she should not get the £17.10 disregard.

    Edited: Just to clarify, I did mean the 30/16 hrs WTC award.

    She would only be entitled to the £17.10 disregard if she receives the 30 hour element in her WTC award.
