ESA Conversion and Non dependants

    Hello,

    Can anybody refresh my memory on non-dependant deductions etc in respect of the ESA conversion?

    basically- is this correct-

    – non-dep converts to ESA- ESA is a “relevant benefit”- but Non-Dep is not a member of the claimant’s family- so change is NOT decided under the Decision Making and Appeals regs- it is decided under normal C of C reg- so takes effect from the following Monday? (ie NOT the exact date)

    Tend to agree but I’m struggling to think how it could affect entitlement either way (unless non-dep has a working partner?).

    Thanks Andy,

    I think i’m thinking of those who are under 25 and currently on IS= non HB non-dep deduction. They convert to ESA(IR) and the lowest non-dep deduction begins.

    Can I ask a further question- in the circumstances above, if the CLAIMANT was a pensioner- would the non-dep deduction DELAY be applied?

    Oh yes – didn’t think of that scenario. If claimant was 65+ (easy to forget that deferred deductions don’t apply to all pensioners) then I see no reason why a 26 week delay wouldn’t kick in. It is certainly a change in the non-deps circs that causes a higher level of deduction to be due.
