Estonian Couple with no Child Benefit in payment

    We have a case from an Estonian Couple who are working, but do not get any Working Tax,Child Tax or Child Benefit in payment. Can we include the children on the claim or should we just assess the claim on the couple with no children and no Child Premuims???

    If the children live with them they are included.

    If they are responsible for the children and they normally live with them then I’d say yes include them in the claculation. There is no need for Child Benefit etc to have been claimed.

    Hi

    Just to clarify – we have a similar case where we have children in the claim but no child benefit has been claimed yet. We have included the children and awarded the correct amount of LHA but we are unsure whether we can include the premiums due to no CB being awarded yet. Can you advise?

    The fact that you have decided the children are part of the household means they are entitled to the premium.

    You always need to keep in mind that it is up to a parent whether or not they claim Child Benefit, it’s not mandatory and doesn’t in itself trigger whether or not a dependant premium is awarded, it’s merely a good indicator of a dependants existence. A person can still receive child benefit even if the child is not living with them.
