ex-partner has been paying rent

    Hopefully, a quickie – the ex-partner of an applicant has been paying the rent for a council tenant who has now claimed.

    How would you take it into account? – We are minded to take it into account as maintenance, and if he stops paying it when HB is awarded then to treat that as a COC.

    HB Regs Schedule 5 (14) (2) applies and I would agree with you.

    Do I know what I'm doing? The jury's out on that........................

    You say “council tenant”….is the tenancy solely in the name of your claimant?

    Offhand I don’t know – what is your line of thought?
    Certainly we have decided to treat our claimant as liable for 100%.
    I should have mentioned that the ex has moved out, by the way…although replies have assumed this anyway.

    Sorry, caveat was poorly worded.

    If your claimant’s partner is the tenant I can see now way you can treat your claimant as liable – Reg 8: …”because the person liable to make them is not doing so and either”…

    If tenenacy is joint or in your claimant’s name then I see no problem.
