Exemption Query

    We have a case where a property has had an exemption on it for the past 2 years due to the previous owner dying and no grant of confirmation of estate being awarded.

    The property has been sold on. The new owners want to claim Uninhabitable exemption. As it has not been previously occupied prior to them buying it am I correct in saying they cannot have the exemption.



    Sticking head above parapet but I would agree with you. My IRRV notes suggest that only a maximum period of 12 months should carry an exemption.

    Willing to be corrected though!

    Do I know what I'm doing? The jury's out on that........................

    You need to determine the date upon which the property became uninhabitable and count the 12 months from then – the fact that it previously had a Class F for two years doesn’t really matter as Class F and Class A can run concurrently or consecutively depending on the circumstances.
