Exemption query (Scotland)

    Customer owns a 2nd home in our area which has been damaged by flooding of raw sewerage due to the adjacent owner damaging pipes.
    She has applied for an exemption due to the property being uninhabitable and undergoing repairs.

    My thoughts are that she can’t get this exemption due to the property not being their main home and therefore not being occupied (as someone’s sole or main residence) in the last 12 months. Plus I’m not sure that replastering and replacing floor boards would constitute major repair work.

    Do you agree??


    I agree that the exemption is not approriate.

    As you said, it must have been occupied within the last 12 months.
