Where I/S etc ends on a Sunday we have been happily awarding 4 weeks extended payment from the Monday, however some assessors have attended a training day where EBP’s came up. During discussions it would appear that most people are ending the I/S claim from the Sunday following and then awarding 4 weeks extended payments.

There has been debate over this in the past but any advice on how other authorities action these payments would be appreciated.

I always used to end the claim the following Sunday, so effectively giving 5 weeks run-on….however, it came to my attention, on hbinfo I think, that if IS ends on a Sunday and EP is applicable, it should be ended on that actual day, so the EP is awarded from the very next day (the Monday). This is also backed up in Zebedee and regs.

This has recently been discussed and analysed in detail:

A majority view (I think!), but far from unanimous, is that if IS/JSA entitlement INCLUDES the Sunday (e.g. 8th Oct 06), then the EP takes effect from the “2nd” Monday (e.g. 16th Oct 06). This interpretation now seems to be accepted by the DWP – see the earlier thread. That would mean the Zebedee/Ward/Lister guide is incorrect.

Andy Illingworth was chasing this up with John Zebedee. Any luck Andy?
