    Hi, something that’s probably crystal clear but is currently causing me some confusion…

    Where someone is eligible for an EP, by when must they submit a new application in order for their claim to effectively be continuous?

    I have it on good authority that an application must be received within 4 weeks of the last entitlement to HB (but not the EP period) for this to happen. Thus, the claim must effectively be made within the EP period.

    However, Reg 72(6)(b) seems to me to be saying that they also have the 4 weeks after the EP in which to make a claim (ie. 8 weeks in total). I’m referring to the wording below:

    “Any claim for HB made…within the (Extended Payment) period….or 4 weeks thereafter shall be treated as having been made in respect of a period beginning immediately after the end of his previous benefit award.”

    Would appreciate it if anyone could put me straight on this please.

    I agree with the 28 days after the end of the EP period scenario.

    I also agree – but have found that the way that this paragraph of the reg is set out is rather strange on this website – had to go back to the paper copy in this office to make sense of it.

    Also agree they have four weeks from the end of EP period in which to make new claim and for the claim to then be paid without any break.

    Do I know what I'm doing? The jury's out on that........................

    Thanks guys, that is how I had read the reg, but I now feel more comfortable having had other agree.
