Family member now turned 21

    Hi I wonder if anyone can help… I am dealing with a claim from a lady from Lithuania, I am reconsidering a decision not to award HB from March 2010. At that time we decided that she did not have a right to reside but now we know that she was a family member of an EEA national at that time. The problem is that she turned 21 in March this year so does she cease to be a family member at that point? Also, she first entered the UK in August 2006 and so could she potentially obtain a permanent right of residence once she has been here for 5 years or does the period from March when she turned 21 to August throw a spanner in the works? Hope you can help?

    She does not necessarily cease to nbe a family member, but she has to satisfy further conditions once she is 21. she must be dependant on the principal EEA national, which means she is receiving a significant amount of support towards the necessities of life: food, clothing, shelter or the money to pay for those things. If she can keep that going until August she will then be home and dry with five years under her belt.
