Fit & Proper Landlord

    We have identified that a landlord in our area, (with seven properties ) was convicted 10 months ago for benefit fraud. (He does not live in our area). We consider him to be unfit to receive HB payments and would like to pay claimant direct. However, his properties are all managed by an agent. In your opinion should we pay the agent?

    This is the first time we have decided that the landlord is not fit & proper and your opinions would be appreciated.

    I don’t see how you can avoid paying the agent, unless they are also deemed not fit and proper persons for payment of HB. As you don’t say so, I assume that they don’t fall into that category.

    Are your claimants in 8 weeks (+) arrears or would it be in their over-riding interest to pay the claimant themselves?
    Or have the claimants requested payment to the third party, and if so, was it the NFP landlord or the agents.

    I think that this is possibly your best starting point.

    Do I know what I'm doing? The jury's out on that........................
