Fluctuating capital

    We have a claimant who has capital of approximately £16,000. Our problem is that his capital fluctuates, and for a couple of weeks it will be just over £16,000, but then he will withdraw some money, taking it just below £16,000 for a few days. Then money gets paid into the account, taking it back above £16,000 again (and so on and so on).
    Is there any reg covering this situation, or do we literally have to keep awarding benefit then cancelling it again every time the capital goes over or under £16,000?

    Payments cannot be income and capital at the same time, so if there are any items which are paid in advance (even partially) you should not be treating them as capital until the end of the payment period.

    Eg if claimant gets his monthly wages on the 22nd, you should not treat that as capital until the 1st of the following month.
